Terms and conditions

These Terms and conditions (“Terms” or "Agreement") are a binding legal agreement between you and AgriStay, that set forth the general Terms and conditions of your use of the agristay.no/agristay.com/agristay.net website ("Website" or "Service") and any of its related products and services (collectively, "Services"). By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the Terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the Terms "User", "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the Terms of this Agreement, you must not accept this Agreement and may not access and use the Website and Services. You acknowledge that this Agreement is a contract between you and AgriStay, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services. The AgriStay Platform offers an online venue that enables users to publish, offer, search for, and book farm stays and related products. Users who search for, book, or use services are “Guests”. Users who publish and offer services are “Hosts” or “Farms”, and the website used by a farm to sell it’s products is called “Listing” or “Booking site”.  

 

General Terms 

  1. Age Requirement: To make a booking or rent out your property on the AgriStay platform, all users, Guests, and Hosts must be 18 years or older. 

  2. Liability: AgriStay and its owners assume no responsibility for any losses, damages, or injuries that Guests may incur during their stay. It is the responsibility of the farm owners to secure adequate insurance coverage for any such incidents. 

  3. Governing Law: These Terms and conditions are subject to the laws of the jurisdiction in which the farm stay is located. 

 


If you are a Guest, the following Terms apply to you: 

  1. Booking: All bookings must be made through AgriStay´s booking website. When you have payed and received the booking confirmation, a contract is formed directly between you and the Host. In addition to these Terms, you must abide by the Terms of the Host including, but not limited to, the cancellation policy and any other rules or requirements specified on the farms´ Booking site. It is your obligation to thoroughly read and comprehend these rules and requirements before making a booking. 

  2. Booking Modifications: Hosts and Guests are responsible for any changes made to their bookings, whether through the AgriStay platform or through direct communication with an AgriStay representative. Hosts and Guests agree to pay any additional fees, taxes or charges related to the booking modifications. In the event of a change in the reservation, the value-added tax will be adjusted to reflect the alterations. 

  3. Cancellation and refunds: Hosts have the ability to set their own cancellation policies, and it is the responsibility of Guests to familiarize themselves with these policies in the event that they may need to cancel a confirmed booking. If a Guest cancels a booking, the transaction fee charged by the payment processing platform Stripe will be deducted from the total amount and will not be refunded, regardless of the cancellation policy. During the processing time, AgriStay may temporarily place a hold on the Guest's credit card.

  4. Damages: In the event that a Host provides evidence of damage, you are responsible for paying damage claims and the amounts necessary to cover damage caused by you, your Guest(s) or your pet(s).   

  5. Personal responsibilities: When booking your stay through AgriStay, please be mindful you are a Guest in someone´s home. As a Guest you are responsible for leaving an accommodation and the farm in general in the condition it was in when you arrived. You must comply with local laws and property rules at all times.  

  6. Host Terms: Each farm may have distinct Host Terms, which are outlined on their respective booking sites. If Guests fail to abide by the rules specified by the Host, they may be requested to vacate the property, in which case the cancellation policies will not be applicable. The Host Terms may include, but are not limited to, the following provisions: 

  • Occupancy: The maximum number of Guests allowed in each accommodation is stated on the Farm’s Booking site. Any additional Guests are not permitted. 

  • Smoking: In some countries, like Norway, smoking is allowed in designated outdoor areas and in private residences. However, landlords have the right to impose a smoking ban in rental properties, and as such smoking may not be allowed on the farm. 

  • Pets: Pets may not be allowed in farm stay accommodations for various reasons, including the presence of roaming farm animals. 

  • Arrival and departure times: Minimum number of nights, check-in time and check-out time will be defined by the Host on the farm's booking site  

 
 

If you are a Host, the following Terms apply to you: 
 

  1. Being a host: If you work with a co-Host or Host as part of a team, business or other organization, the entity and each individual who participates in providing Host Services, is responsible and liable as a Host under these Terms.   

  2. Managing and updating your Listing: Your Listing must include complete and accurate information about your Host Service, your price, other charges like additional services or products, and any rules or requirements that apply to your Guests or Listing. You may only maintain one Listing per Accommodation, but may have multiple Listings for a single property if it has multiple places to stay.   

  3. Pricing: It is the responsibility of the Host to establish a standard nightly rate, which will be displayed in the calendar. This rate must include all necessary expenses, including cleaning costs and VAT. The Host may choose to set a customized price for dates of high demand, such as holidays and special events. Additionally, the Host may offer supplementary products, such as breakfast, courses, fishing licenses, etc., which have the potential to increase revenue for the lodging. 

  4. Service fees: The Host must take into account the service and marketing fee owed to AgriStay, which is set at 15% unless otherwise agreed upon. This fee is associated with each Guest booking and will be deducted from the Host's payment upon completion of the stay. The service fee includes the transaction fee charged by the payment processing platform Stripe.

  5. Payout: Payout to the accommodation provider takes place on the 1st and 15th of each month, following the completed stay. The payout will include value-added tax (VAT), which the farm must pay. VAT per stay can be easily downloaded via the farm's control panel and booking page.

  6. Bookings and contracts: When you accept a booking request, or receive a booking confirmation from AgriStay, you are entering into a contract directly with the Guest. This means you are responsible for delivering the Host Service under the Terms and at the price specified on your Booking site. You are also responsible for paying all applicable fees to AgriStay and any taxes as required by Norwegian law. Payment will be processed through the Stripe service.

  7. Cancellations and Travel Issues: In general, if a Guest cancels a reservation, the amount paid to you is determined by the cancellation policy that applies to that reservation. As a Host, you should not cancel on a Guest without a valid reason. If a Guest cancels a booking, the transaction fee charged by the payment processing platform Stripe will be deducted from the total amount and will not be refunded, regardless of the cancellation policy. During the processing time, AgriStay may temporarily place a hold on the Guest's credit card.

  8. Booking Modifications: Hosts and Guests are responsible for any alterations made to their booking through the AgriStay platform or via direct communication with an AgriStay representative. Such alterations, referred to as "Booking Modifications," may result in additional fees, charges or taxes, which the Host and Guest agree to pay. Value-added tax (VAT) is applied to all bookings and, in case of changes to the booking, VAT will be adjusted accordingly. 

  9. Abide by local laws: As a Host, it is your responsibility to be familiar with and comply with the laws and regulations related to aspects such as insurance, fire safety, electricity, food preparation, serving alcohol for sale, etc. You must determine which regulations apply to the Host Services you plan to offer. The information we provide regarding legal requirements is for informational purposes only and it is your responsibility to verify your obligations independently. Additionally, you are responsible for managing and utilizing the personal data of Guests and others in accordance with applicable privacy laws. 

  10. Host Taxes. As a Host, you are responsible for fulfilling your obligations according to applicable laws and regulations for reporting, collecting, and paying VAT, and other taxes and fees. Information regarding VAT related to the accommodations is readily available for download from your dashboard.

  11. Your responsibilites: You are responsible for keeping your Listing information, calendar availability and content up-to-date and accurate. You are responsible for setting your price and establishing rules and requirements for your farm accomodation. We recommend that you obtain appropriate insurance for your Host Services and suggest you carefully review policy Terms and conditions like coverage details and exclusions.  

 

Terms Changes: AgriStay reserves the right to modify these Terms and conditions at any time. These terms were last updated at July 1st 2023. If there are changes to the service fees, we will provide you with prior notice before they take effect.
